UPDATE..... I called FedEx yesterday to see how we were doing on the claim. I was told by the claims agent. Do not call us, the claim is in process. The claims agent will notify you if further correspondence is required..... That made me feel real good.

Bryan, that really sux. They have no right to treat people that way. The mistake is 100% theirs. I dont blame you fir being upset, and you are handling it better than me.

A racoon chewed on the corner of my front bait tank top which is also the bottom of the seat. Sun Tracker wanted $585 for a replacement seat bottom. I told them I could buy complete consoles from Overton's for less than that. I was told that was the price, take it or leave it.
I took the unit to a local upholstery shop and had it recovered for $50.00.

I never accept anything that the box is crushed on until I inspect it in front of the delivery driver. If it is damaged, I don't keep it and call the shipping company and the person I bought if from. I ordered some custom seats from Veada last year and had to go to the freight company to pick them up. Of course the boxes were all crushed so I got the manager of the depot out there and made them take each unit out of the boxes so I could inspect them. Luckily for them nothing was damaged but they acted like they were put out to have to open all 10 boxes.

Personally, I would have thought the dealer would have replaced the part and they would be the ones working with FedEx to get reimbursed for the loss.
YOU are the customer who should have the part ordered in undamaged condition.
Shouldn't need a "check" from FedEx but rather a new railing section from the dealer.

I was contacted by FedEx on Monday, the claim is being worked on. Premier told me its my baby, because it was shipped out in good condition. The adjuster told me this is the way it works, when you accept a "hidden damage" item. Even though you can clearly see the where the box, packing and panel were hit by the forklift. Its not like its from WalMart, where I could just take it back and get another. Premier does not want it back, nor will they build another and send it out for free. They will charge me for another and refund me when FedEx pays their claim. Its unfortunate it happened. If they take care of it, fine. If not.... That's life in todays world! I'm so sure that it will NOT be dealt with, that I already took out the panel I needed and put in on the boat. Hell with them. The replacement looks great and will be much safer for the grandkids, with the opening between the railing enclosed. If nothing comes from it, that's all right. Every dollar spent to keep every child that steps on my boat safe, is worth it.

The only time I ever made a shipping damage claim nobody would talk to me at all since I didn't directly pay the shipper. I was at the mercy of the seller to handle it properly and timely. I did NOT like feeling helpless since I was out the money and there was little motivation on the seller's part to make it right, other than reputation.
So accepting the package and later finding damage is a complete game-changer as to who is responsible? That doesn't make sense to me. YOU contracted with the seller to receive an item as described. HE contracted with the shipper to deliver that item undamaged. If the shipper failed, it's the seller's responsibility to file the claim as the one who paid for the service.
That said, you might prefer to be in the driver's seat but there's another consideration: Does FedEx care if they piss off one customer? The seller might send out a stack of boxes every single day so he might have a lot more pull than you.

Worked out fine... I am keeping this panel. I wish I could have just bought the fence panels I needed instead of having to buy the whole assembly. But since they took care of it, no big deal. Just a bit more labor intensive to remove the panels and install them. I didn't ask for the whole price of the assembly. I figured the parts I am removing are worth a few hundred bucks, so I told them I would be happy with the price I paid, minus what we figured the parts I am using are worth. But, they paid me for the whole thing. So I'm tickled pink!
